The Board’s primary responsibility is to regulate the process through which attorneys are permitted to represent themselves as specialists in Minnesota. The Board accredits agencies to certify attorneys as specialists. According to the Board, “The certification process gives the public information about certain attorneys who have earned the right to call themselves specialists in certain fields of law.” Currently, five agencies have been accredited to certify attorneys as specialists in ten areas of the law, ranging from criminal and civil trial law to real estate and labor and employment law.

The Board’s Criminal Trial Committee is responsible for ensuring that the agencies that certify criminal law specialists are meeting the standards set by the Minnesota Supreme Court. This includes a review of the agencies themselves and the examinations used to certify attorneys as specialists in the area of criminal law. One of those agencies is the Minnesota State Bar Association (MSBA) Criminal Law Section, which defines “criminal law” as “the practice of law dealing with the defense or prosecution of crimes in state and federal trial courts.”

Jacobson is a shareholder at Swenson Lervick and is certified by the MSBA as a Labor and Employment Law Specialist. As noted by the MSBA:

The Labor & Employment Law Specialty Field is the practice of law dealing with relationships among employers, employees, and labor organizations, except workers’ compensation. It includes all aspects of labor relations and employment law, both public and private, employment-related statutes, employment-related torts and contracts, and employment discrimination. This definition includes all forms of labor and employment litigation, advice, counseling, negotiations, arbitration, mediation, and other forms of alternative dispute resolution before all tribunals.
